This Privacy Policy explains how Romantic Circle: Spin & Kiss (the “App”), developed and operated by FUNAPP LTD, collects, uses, shares, and protects your information.

  • User Content: messages, chat, text, emojis, photos or media (if such features exist), virtual gifts you send or receive, and other content you create or share in the App.
  • Support data: information and attachments you send when contacting our support team (including email address and description of the issue).

We strongly discourage users from sharing sensitive personal information (such as full name, address, financial data, or ID documents) in their profiles or chats.


1.2. Automatically Collected Information

When you use the App, we may automatically collect:

  • Device information: device model, operating system version, language, time zone, device settings.
  • Identifiers: app-specific identifiers (for example, IDFV on iOS) and other identifiers provided by the platform. If we use advertising technologies, we may also process the advertising identifier (such as IDFA), in compliance with platform rules and your consent choices.
  • Usage data: your interactions with the App, such as screens viewed, buttons clicked, time spent in different sections, features used, and in-app events (for example, spins, matches, gifts sent/received).
  • Log and diagnostic data: crash reports, performance logs, and error messages to help us maintain stability and security.
  • Purchase and subscription data: information about in-app purchases and subscriptions (type of product, transaction date, subscription status). Payment details (such as card numbers) are processed by Apple or other platform providers and are not stored by us.

1.3. Analytics & Third-Party Services

We may use trusted third-party service providers (for example, analytics, crash reporting, cloud storage, remote configuration, or message delivery) to help us:

  • understand how the App is used;
  • improve functionality, balance, and performance;
  • maintain stability and security;
  • manage notifications and feature experiments.

These providers may process anonymized, pseudonymized, or aggregated technical data on our behalf. They are not allowed to use your data for their own independent marketing purposes.


1.4. No Unnecessary Sensitive Data

The App does not require or intentionally collect:

  • medical records or health data (in the sense of clinical records);
  • biometric identifiers;
  • your precise GPS location (beyond coarse info like country/region if you choose to provide it);
  • access to your contacts or address book;
  • access to your personal photo library outside of what you explicitly choose to upload in the App.

If you choose to share photos or sensitive information in User Content, you do so at your own risk. We may remove such content if it violates our Terms.


2. How We Use Your Information

We use your information to:

  • Operate and provide the App and its core functionality (including spins, matches, gifts, virtual currency, and social features).
  • Create and manage your account and profile.
  • Show your profile and User Content to other users according to the App’s features (for example, when you appear on a board, in a match, or in chat).

    • suggesting relevant matches or boards,
    • displaying your progress, statistics, or leaderboards,
    • adjusting offers, promotions, or in-app events.
  • Process purchases and subscriptions, verify transactions with Apple or other platform providers, and manage access to premium features.
  • Provide customer support and respond to your requests.
  • Monitor and enforce safety, security, and compliance, including detecting fraud, abuse, or violations of our Terms (such as illegal or harmful content).
  • Improve the App, including testing new features, performance optimization, and analytics.

We do not sell your personal data.


3. Legal Bases for Processing (EEA/UK Users)

If you are in the European Economic Area, the United Kingdom, or a similar jurisdiction, we process your personal data on the following legal bases:

  • Performance of a contract: to provide the App and fulfill our agreement with you (for example, creating your account, enabling spins, matches, and in-app purchases).

We may disclose your information if we believe in good faith that it is reasonably necessary to:

  • enforce our Terms and protect the safety, rights, or property of FUNAPP LTD, our users, or the public;
  • detect, prevent, or address fraud, security issues, or technical problems;
  • report child sexual abuse material or other serious violations to the appropriate authorities.

4.4. Business Transfers

In connection with a merger, acquisition, restructuring, or sale of all or part of our assets, your information may be transferred to the acquiring entity, subject to the same or equivalent privacy protections.

We do not sell or rent your information to advertisers.


5. Data Storage, Security & Retention

5.1. Storage locations. Data may be stored on secure servers in the European Union or other regions where our service providers operate.

5.2. Security measures. We use reasonable technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

5.3. Retention. We retain personal data for as long as necessary to:

10. Biometric Data or Face Data collection

NO BIOMETRIC / FACE DATA is collected.

The App does not collect or process biometric data or face data of any kind.

Any photos a user uploads or captures are treated as standard user content and are used solely for displaying the user’s profile.

The App does not perform facial recognition, face analysis, or measurement of facial characteristics.

We do not collect, store, analyze, or process any biometric identifiers or face data. User photos are optional and are used only as profile images.

1. Introduction; Agreement to These Terms of Use

1.1. These Terms & Conditions (“Terms”) and the Privacy Policy form a legally binding agreement between you and FUNAPP LTD (“we”, “us”, “our”) regarding your use of the Romantic Circle: Spin & Kiss mobile application (the “App”).

1.2. By installing, accessing, or using the App, you:

  • acknowledge that you have read and understood these Terms and the Privacy Policy; and
  • agree to be bound by them and to comply with all applicable laws and regulations.

1.3. If you do not agree with any part of these Terms or the Privacy Policy, you must:

  • immediately stop using the App; and
  • uninstall the App from your device.

1.4. We reserve the right to amend these Terms and the Privacy Policy from time to time.

By continuing to use the App after such changes become effective, you agree to the updated version.

2. Eligibility & Age Requirements

2.1. Romantic Circle: Spin & Kiss is intended for adults only. You may use the App only if you are at least 18 years old (or the age of legal majority in your country, if higher).

2.2. By using the App, you represent and warrant that:

  • you are at least 18 years old;
  • you have the right, authority, and capacity to enter into this agreement; and
  • you will comply with these Terms and all applicable laws.

2.3. We may suspend or terminate your access to the App if we reasonably believe that you are underage or have provided false information about your age.


3. Use License

3.1. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • download and install one copy of the App on a device that you own or control; and
  • use the App solely for your personal, non-commercial entertainment.

3.2. This is a license, not a transfer of title, and under this license you may not:

  • modify, copy, adapt, translate, or create derivative works based on the App or its materials;
  • use the App or its materials for any commercial purpose or public display;
  • attempt to decompile, reverse engineer, or otherwise obtain the source code of the App;
  • remove or alter any copyright, trademark, or other proprietary notices;
  • transfer, resell, lease, lend, or sublicense the App, your account, or any virtual items to another person;
  • “mirror” or frame the App or its materials on any other server or service.

3.3. This license will automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon termination, you must stop using the App and delete all copies in your possession or control.


4. Accounts, Registration & Security

4.1. Some features of the App may require you to create an account or sign in using a third-party service (such as Apple, Google, or other providers), or to create a profile (nickname, avatar, etc.).

4.2. If you create an account or profile, you agree that:

  • the information you provide is accurate and up to date;
  • you will not impersonate any person or entity and will not use a username that is offensive, vulgar, or misleading;
  • you are responsible for maintaining the confidentiality of your login credentials; and
  • you are responsible for all activities that occur under your account.

4.3. We may, at our discretion, limit, suspend, or terminate your access to the App if we believe that:

  • you have violated these Terms;
  • you are using the App in a fraudulent, abusive, or harmful way; or
  • it is required by law or requested by authorities.

5. Virtual Currency, Gifts & In-App Purchases

5.1. The App may include virtual currency (for example, “Hearts”) and virtual items (for example, gifts, frames, cosmetic items, spins, or other digital content) that you can earn or purchase (“Virtual Items”).

5.2. Virtual currency and Virtual Items:

  • have no real-world monetary value;
  • cannot be exchanged for real money or real-world goods or services;
  • cannot be withdrawn, redeemed, or refunded as real money; and
  • may only be used within the App according to its rules and features.

5.3. Certain features (for example, spins, sending gifts, or unlocking special effects) may require spending virtual currency or purchasing Virtual Items via in-app purchases.

5.4. In-app purchases and subscriptions are processed via the App Store (Apple) or other platform providers. When you make a purchase:

  • payment will be charged to your Apple ID / platform account at confirmation of purchase;
  • subscription plans (if available) may auto-renew unless you turn off auto-renewal in your account settings at least 24 hours before the end of the current period;
  • your account may be charged for renewal within 24 hours prior to the end of the current period.

5.5. Details of prices, billing periods, and features are shown in the App before you confirm the purchase.

5.6. Refunds: All payments are processed by Apple or other platform providers. We do not issue refunds directly. Any refund requests must be made through the platform (e.g., Apple) in accordance with their policies.

5.7. We reserve the right to:

  • modify, suspend, or discontinue any Virtual Items, offers, or pricing;
  • adjust balances of virtual currency in case of errors, suspected fraud, or technical issues.

You acknowledge that you are not entitled to compensation for any changes in the value or availability of Virtual Items.


6. Simulated Gambling & Game Mechanics

6.1. The App may include simulated gambling-style mechanics, such as spinning wheels, random draws, or chances to win virtual currency or Virtual Items. These features:

  • do not involve real money gambling;
  • do not allow you to deposit or win real money;
  • are provided solely for entertainment purposes.

6.2. No outcome in the App guarantees any real-world reward. All probabilities and results are virtual and may be adjusted for balance, fairness, or technical reasons.


7. User-Generated Content & Community Conduct

7.1. The App may allow you to create or share content, such as:

  • profile information (nickname, biography, avatar);
  • messages or chat with other users;
  • photos or other media (if such features are enabled);
  • reactions, emojis, or other interactive elements

(collectively, “User Content”).

7.2. You remain the owner of your User Content, but by uploading, sending, or otherwise making it available in the App, you grant us a limited, worldwide, non-exclusive, royalty-free license to store, process, display, and use such content solely for operating, improving, and providing the App and its features, in accordance with our Privacy Policy.

7.3. You agree not to create, upload, store, or share any User Content that:

  • violates any law or regulation;
  • includes nudity, pornography, or explicit sexual content;
  • is sexually suggestive involving minors, or depicts or promotes any sexual activity with minors;
  • contains threats, harassment, bullying, or stalking;
  • promotes self-harm, suicide, or violence;
  • promotes hate, discrimination, or degradation toward individuals or groups based on race, ethnicity, religion, disability, gender, sexual orientation, gender identity, nationality, or any other protected characteristic;
  • promotes terrorism, criminal activity, or illegal drugs and weapons;
  • includes excessively violent, graphic, or shocking content;
  • violates privacy or publicity rights of others, including sharing personal data, photos, or content without permission.

7.4. We operate a zero-tolerance policy toward:

  • child sexual abuse material;
  • content that sexually exploits or endangers minors;
  • serious threats of violence or criminal activity.

If we become aware of such content, we may:

  • remove or block the content;
  • suspend or terminate the account;
  • report it to the appropriate authorities.

7.5. You also agree not to:

  • spam other users or send unsolicited commercial messages;
  • attempt to obtain passwords or personal data from other users;
  • use the App to advertise third-party products or services without our prior written consent.

7.6. We reserve the right (but have no obligation) to monitor, review, or remove User Content at our discretion, particularly if it violates these Terms or is otherwise objectionable.

7.7. If something in the App bothers you, you believe someone is misusing the App, or you encounter abusive or illegal content, please contact us at support_kiss@funappgame.com.

We aim to review reports of objectionable content and user abuse as soon as reasonably possible, typically within 24 hours.


8. Safety & Interaction with Other Users

8.1. Romantic Circle: Spin & Kiss may connect you with other users in a playful and flirtatious context. You are solely responsible for:

  • your interactions with other users; and
  • any information or content you choose to share.

8.2. We do not conduct criminal background checks on users. We do not guarantee the identity, intentions, or behavior of any user.

8.3. You should never share sensitive personal information (such as your home address, financial details, or documents) with other users. If you feel unsafe or harassed, stop communication and report the user.


9. Disclaimers & Limitation of Liability

9.1. The App and all content are provided on an “as is” and “as available” basis. We make no warranties, express or implied, including, without limitation:

  • implied warranties of merchantability;
  • fitness for a particular purpose;
  • non-infringement of intellectual property or other rights.

9.2. We do not warrant that:

  • the App will be uninterrupted, secure, or error-free;
  • defects will be corrected;
  • the App or servers are free of viruses or harmful components;
  • any specific results will be achieved by using the App.

9.3. To the maximum extent permitted by law, FUNAPP LTD and its officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or in connection with your use of (or inability to use) the App, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow limitations on implied warranties or certain types of liability, so some of the above limitations may not apply to you.


10. Links to Third-Party Services

10.1. The App may contain links to third-party websites or services or integrate third-party content (for example, sign-in services, analytics, or support tools) that are not owned or controlled by FUNAPP LTD.

10.2. We are not responsible for:

  • the content, privacy practices, or policies of third-party websites or services;
  • any loss or damage that may arise from your use of them.

10.3. Use of any third-party website or service is at your own risk. We recommend that you review their terms and privacy policies.


11. Modifications to the App and These Terms

11.1. We may modify, suspend, or discontinue the App or any of its features at any time, with or without notice.

12. Governing Law & Dispute Resolution

12.2. You irrevocably submit to the exclusive jurisdiction of the courts of Malta in relation to any dispute or claim arising out of or in connection with these Terms or your use of the App.

  • immediately stop using the App; and

4.3. The App is not a substitute for professional medical care or therapy.

4.4. By using the App, you acknowledge that any decisions you make based on content from the App are made at your own risk.


5. Payments and Subscriptions

5.1. Some features of the App are available only through paid subscriptions. Payments are charged as recurring subscriptions with different periods (e.g., weekly, monthly, yearly), as offered in the App.

5.2. By default, subscriptions are auto-renewing. You can manage or cancel auto-renewal at any time in your Apple ID / App Store account settings.

5.3. A subscription grants you access to premium functionality, which may include (depending on the plan):

  • full access to premium affirmations and categories;
  • advanced mood tracking and insights;
  • additional personalization and audio features;
  • an ad-free experience (if applicable);
  • early access to new content and features.

5.4. We reserve the right to offer free trial periods for certain subscription types.

5.5. Subscription terms, prices, and features are shown clearly in the App before you confirm a purchase.

5.6. Payment will be charged to your Apple ID account at confirmation of purchase.

5.7. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

5.8. Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified in your App Store account.

5.9. You can manage your subscriptions and turn off auto-renewal by going to Account Settings in your device’s App Store / Apple ID settings after purchase.

5.10. Any unused portion of a free trial period (if offered) will be forfeited when you purchase a subscription.

5.11. Refunds: All payments are processed by Apple. We do not issue refunds directly. Any refund requests must be made through Apple in accordance with their policies.


6. User-Generated Content & Prohibited Content

6.0. The App may allow you to create or store text, notes, affirmations, or other content (“User Content”). Even if this content is primarily for your private use, we maintain a zero-tolerance policy for objectionable content and abusive behavior in any interactive or shared features of the App (now or in the future).

6.1. You agree not to create, upload, store, or share any content that:

  • violates any law or regulation;
  • contains threats, harassment, or bullying;
  • promotes self-harm, suicide, or violence;
  • promotes hate speech or discrimination against individuals or groups based on race, ethnicity, religion, disability, gender, sexual orientation, gender identity, nationality, or any other protected characteristic;
  • promotes illegal activities, including illegal drugs or weapons;
  • contains explicit sexual content or pornography;
  • depicts or encourages harm to children or any form of child endangerment.

6.2. We do not allow:

  • any form of child sexual abuse material;
  • content that depicts or instructs on violent or dangerous activities;
  • content that promotes terrorism or criminal behavior.

6.3. If we become aware of content involving child sexual abuse or other serious violations, we may:

  • remove such content;
  • block or terminate the account;
  • report it to the appropriate authorities.

6.4. Any behavior that is likely to offend or harm other users is unacceptable. If the App includes any community or sharing features, we reserve the right to:

  • remove objectionable content;
  • suspend or eject users who violate these rules.

6.5. If something in the App bothers you or you believe someone is misusing the App (e.g., abusive behavior in any future community features), please contact us at  support@funappgame.com.

We aim to review reports of objectionable content and user abuse and to respond as soon as reasonably possible, typically within 24 hours.

6.6. You remain the owner of your User Content but grant us a limited license to store, process, and use that content solely to operate and improve the App, in accordance with our Privacy Policy.


7. Disclaimers, Limitations & Accuracy of Materials

7.1. The materials and content in the App are provided on an “as is” and “as available” basis. We make no warranties, expressed or implied, and hereby disclaim all other warranties, including without limitation:

  • implied warranties of merchantability;
  • fitness for a particular purpose;
  • non-infringement of intellectual property or other violation of rights.

7.2. We do not warrant or make any representations regarding:

  • the accuracy, reliability, or results of the use of the materials in the App;
  • that the App will be uninterrupted or error-free;
  • that defects will be corrected;
  • that the App or servers are free of viruses or other harmful components.

7.3. The materials in the App may include technical, typographical, or other errors. We do not guarantee that any of the materials are accurate, complete, or current. We may make changes to the materials at any time without notice, but we do not commit to updating them.

7.4. There is no tolerance for objectionable content or abusive users.

We do not allow the use of photos that are not you, photos containing nudity or prohibited items, or photos of underage children.

We regularly inspect pictures uploaded by users and permanently delete prohibited content as well as permanently block the users of such content.

Any behavior that could offend other users is unacceptable.

You can filer, report and block any user if their actions insult you or if you think that the user is using prohibited content or behaving in an unacceptable manner.

We regularly check all violation reports and user abuses on objectionable content within 24 hours by removing the content and ejecting the user who provided the offending content.

6.1. Restricted Content
